{"id":5138,"date":"2020-01-17T09:17:22","date_gmt":"2020-01-17T09:17:22","guid":{"rendered":"https:\/\/revistaidees.cat\/vint-anys-dimpasse\/"},"modified":"2020-06-20T12:44:26","modified_gmt":"2020-06-20T12:44:26","slug":"vint-anys-dimpasse","status":"publish","type":"post","link":"https:\/\/revistaidees.cat\/en\/vint-anys-dimpasse\/","title":{"rendered":"Twenty years of impasse"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The debate on mobility today revolves around goals, instruments and results that countries of origin, destination and transit coordinate in relation to the phenomenon. Thus, it is a public policy debate that is essential to every state, as it affects key constitutive elements such as territory and population. Furthermore, in the case of European immigration and asylum policy, it also affects the concept of sovereignty, as such policy can only be constructed through the converging wills of European Union Member States. The aim of this article is to examine some of the most pressing issues in European immigration and asylum policy, 20 years after its introduction. <\/p>\n\n\n\n<h5 class=\"wp-block-heading\">The European immigration policy construction process <\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">In the context of the European Union, the consolidation of the Schengen area, which permits free movement of persons between the countries within it, is one of the advances most highly valued by European citizens <span class=\"note-item\"><a href=\"#note-01\" class=\"scroll-to\">[1]<\/a><span class=\"note-item-tooltip\">1 \u2014 Vegeu Eurobar\u00f2metre 474 de 2018 \u201cEuropeans\u2019 perceptions of the Schengen Area\u201d\n<\/span><\/span>,  and a paradigmatic example of the construction of an interrelated supranational area with its own regulatory framework. Coordination of a common internal area, with no internal borders, that favours the movement of citizens living in the territory explains the need to formulate a common approach regarding external borders, as well as determine who, how and why they may be crossed. European immigration policy thus arose as a requirement for guaranteeing the area of free movement, with the aim of constructing common, shared instruments in this field. Hence it differs from other fields of work: immigration policies affect two key conditions of the nation-state on which the current international system is based: population and territory. Indeed, joining a country\u2019s society and the way this process is coordinated are common issues for European states, thereby explaining the degree of reluctance in giving up competencies in this field among the Member States over the last 20 years. From the very beginning of the European Union, immigration policy was drawn up as a complicated balance between national sovereignty and European integration, with a clear tension between state logic and supranational dynamics   <span class=\"note-item\"><a href=\"#note-02\" class=\"scroll-to\">[2]<\/a><span class=\"note-item-tooltip\">2 \u2014 Goig Mart\u00ednez, J. M. (2018). \u201cLa pol\u00edtica com\u00fan de inmigraci\u00f3n en la Uni\u00f3n Europea en el sesenta aniversario de los Tratados de Roma (o la historia de un fracaso)\u201d. Revista de Derecho de la Uni\u00f3n Europea, (32), 71-111.\n<\/span><\/span>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A year after the signing of the Schengen Agreement (1985), the Single European Act stressed the need for the Member States to cooperate with regard to the entry, movement and residence of the non-community population, while accepting that none of the stipulations in the agreement could affect the right of states to adopt whatever measures they considered necessary in controlling immigration from other countries. In 1997, the Treaty of Amsterdam incorporated the Schengen <em>acquis<\/em> into community regulations and two years later, in 1999, the process of coordinating a common immigration and asylum policy began. With the aim of building an area of freedom, security and justice, the issues of immigration and asylum were linked to free movement and visas, as well as external border control and the prevention of and fight against crime. This link between immigration and security  <span class=\"note-item\"><a href=\"#note-03\" class=\"scroll-to\">[3]<\/a><span class=\"note-item-tooltip\">3 \u2014 Pinyol-Jimenez, Gemma. (2018). \u201cHacia una pol\u00edtica europea de inmigraci\u00f3n integral: \u00bfreto o mito? en Closa, C. y Molina, N. (coord.): El futuro de la Uni\u00f3n Europea. Informe Elcano 23: 75-90.\n<\/span><\/span> would vary in intensity and emphasis in subsequent years, but would remain a permanent consideration in the narrative on immigration and asylum in the European Union. <\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-8f761849 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p class=\"wp-block-paragraph\"> El Consell Europeu de Tampere de 1999 va establir quatre punts b\u00e0sics sobre els quals sustentar les pol\u00edtiques d&#8217;immigraci\u00f3 i asil de la Uni\u00f3 Europea: (1) la necessitat d&#8217;un enfocament global en la cooperaci\u00f3 amb els pa\u00efsos d&#8217;origen i tr\u00e0nsit; (2) la gesti\u00f3 efica\u00e7 dels fluxos migratoris; (3) el desenvolupament d&#8217;un sistema europeu com\u00fa d&#8217;asil; i (4) el tracte just a les persones nacionals de tercers pa\u00efsos residents a la UE. Per desenvolupar aquests quatre eixos de treball, es van plantejar diferents agendes de treball, l&#8217;\u00faltima de les quals regeix des de 2015 sota el t\u00edtol d&#8217;Agenda Europea de Migraci\u00f3, i es van desplegar un seguit d&#8217;instruments normatius que intentaven abastar les diferents dimensions d&#8217;aquesta pol\u00edtica. Especialment en els primers deu anys de la pol\u00edtica d\u2019immigraci\u00f3 i asil, es van aprovar directives diverses en q\u00fcestions com el reagrupament familiar, la resid\u00e8ncia de llarga durada, el retorn de les persones nacionals de tercers pa\u00efsos en situaci\u00f3 irregular, el perm\u00eds \u00fanic <span class=\"note-item\"><a href=\"#note-04\" class=\"scroll-to\">[4]<\/a><span class=\"note-item-tooltip\">4 \u2014 La directiva estableix el conjunt com\u00fa de drets que gaudeixen les persones treballadores de pa\u00efsos tercers residents en territori de la Uni\u00f3 Europea. Vegeu Pascouau, Y., &amp; McLoughlin, S. (2012). EU Single Permit Directive: a small step forward in EU migration policy. European Policy Centre. Policy brief.\n<\/span><\/span>, el mecanisme per determinar l\u2019estat responsable per examinar una sol\u00b7licitud d\u2019asil o els requeriments d&#8217;acc\u00e9s i resid\u00e8ncia per a persones amb ocupacions altament qualificades; de treball de car\u00e0cter temporal, intra-corporatiu per raons d&#8217;estudi i investigaci\u00f3 entre d\u2019altres. Tot aquest desplegament legislatiu ha tingut com a objectiu ordenar i harmonitzar els instruments principals d&#8217;entrada al territori de la Uni\u00f3 Europea, prestant atenci\u00f3 a les diferents vies i condicions per les quals podien accedir i residir les persones extracomunit\u00e0ries (fam\u00edlia, estudis o treball) al territori UE. <\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<blockquote class=\"wp-block-quote is-style-large is-layout-flow wp-block-quote-is-layout-flow\"><p>The phenomenon of migration is a constant factor in modern times and the capacity for response by European Union countries will provide better results if can progress, even if just partially, towards joint management above and beyond border control.<\/p><\/blockquote>\n<\/div>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Sense negar la import\u00e0ncia cabdal dels aven\u00e7os fets en aquests darrers anys, que han constitu\u00eft a l\u2019espai europeu un exemple \u00fanic de cogesti\u00f3 supranacional de les pol\u00edtiques migrat\u00f2ries, cal assenyalar algunes disfuncions que han acompanyat aquest proc\u00e9s i n\u2019han limitat el seu impacte. La principal obstrucci\u00f3 a la consolidaci\u00f3 d\u2019una pol\u00edtica europea comuna d\u2019immigraci\u00f3 i asil ha estat el manteniment del principi intergovernamental en l\u2019adopci\u00f3 d\u2019acords en aquestes mat\u00e8ries, que ha derivat en una fragmentaci\u00f3 (sectorialitzaci\u00f3) de les decisions preses, de tal manera que els passos endavant han estat parcials i poc articulats entre ells. L\u00b4\u00fanic espai on hi ha hagut marge per generar consensos ha estat en la protecci\u00f3 de les fronteres exteriors, on s\u2019ha avan\u00e7at de manera m\u00e9s articulada, amb objectius compartits i amb m\u00e9s instruments i recursos que en altres \u00e0mbits, el que ha derivat en una gesti\u00f3 migrat\u00f2ria securititzada que ha contaminat tot el discurs sobre immigraci\u00f3 i inclusi\u00f3 de les persones estrangeres a la Uni\u00f3 Europea. Finalment, les relacions amb els pa\u00efsos tercers tamb\u00e9 han quedat mediatitzades per aquesta perspectiva de seguretat, el que ha derivat, per una banda, en una externalitzaci\u00f3 del control migratori que genera condicionalitat i alhora depend\u00e8ncia en les relacions dels pa\u00efsos europeus amb els seus ve\u00efns, i, per l\u2019altra, ha condicionat altres pol\u00edtiques com, per exemple, la de cooperaci\u00f3 amb aquests pa\u00efsos d\u2019origen i tr\u00e0nsit migratori.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La falta de consensos, la fragmentaci\u00f3, la mirada securit\u00e0ria, l\u2019externalitzaci\u00f3 o la condicionalitat han marcat la construcci\u00f3 de la pol\u00edtica europea d\u2019immigraci\u00f3 i asil, afectant de manera clara en els objectius que la mateixa havia establert a Tampere. En les relacions amb els pa\u00efsos d\u2019origen i tr\u00e0nsit, no s\u2019han constru\u00eft espais de decisi\u00f3 real basats en la coresponsabilitat ni en la gesti\u00f3 compartida, sin\u00f3 que s\u2019han establert relacions basades b\u00e0sicament en l\u2019externalitzaci\u00f3 del control de fronteres i en la dubtosa (i no demostrada) correlaci\u00f3 entre incrementar el desenvolupament en origen per reduir els fluxos migratoris <span class=\"note-item\"><a href=\"#note-05\" class=\"scroll-to\">[5]<\/a><span class=\"note-item-tooltip\">5 \u2014 Landau, L.B., Wanjiku Kihato, C. &amp; Postel, H. (2018). Europe Is Making Its Migration Problem Worse. The Dangers of Aiding Autocrats. Snapshot September 5. Foreign Affairs.\n<\/span><\/span>. A l\u2019hora de parlar de la gesti\u00f3 dels fluxos migratoris, la fragmentaci\u00f3 ha impedit avan\u00e7ar en una mirada integral, focalitzant tota l\u2019acci\u00f3 comunit\u00e0ria en la lluita contra la immigraci\u00f3 irregular. El sistema europeu com\u00fa d\u2019asil no ha estat tampoc capa\u00e7 d\u2019avan\u00e7ar substantivament, i la falta de solidaritat entre els estats membres ha confirmat la defunci\u00f3 d\u2019instruments que, com el reglament de Dubl\u00edn, estaven pensants per anar avan\u00e7ant en l\u2019enfortiment d\u2019aquest sistema. Finalment, i malgrat que l\u2019espai europeu gaudeix d\u2019unes lleis antidiscriminat\u00f2ries fortes, tota la narrativa anterior ha acompanyat un discurs cada cop m\u00e9s negatiu sobre la immigraci\u00f3 a la Uni\u00f3 Europea, provocant l\u2019aparici\u00f3 de nous discursos d\u2019odi amb alt contingut xen\u00f2fob que posen en risc la conviv\u00e8ncia i la cohesi\u00f3 social <span class=\"note-item\"><a href=\"#note-06\" class=\"scroll-to\">[6]<\/a><span class=\"note-item-tooltip\">6 \u2014 De Lucas, J. (2017). \u201cNegar la pol\u00edtica, negar sus sujetos y derechos (Las pol\u00edticas migratorias y de asilo como emblemas de la necropol\u00edtica)\u201d. Cuadernos electr\u00f3nicos de filosof\u00eda del derecho, (36), 64-87.\n<\/span><\/span>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Escenaris de futur per una pol\u00edtica europea d\u2019immigraci\u00f3 i asil<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Vist amb perspectiva, a Tampere es van posar les bases per una pol\u00edtica integral d\u2019immigraci\u00f3 que s\u2019ha demostrat massa ambiciosa. En l\u2019\u00fanic espai que els estats membres han arribat a un consens clar ha estat en la protecci\u00f3 de les fronteres exteriors, encara que hagi estat a costa de reduir la confian\u00e7a i la solidaritat entre aquests. La resta d\u2019instruments que es van plantejar i en els quals s\u2019ha anat avan\u00e7ant lentament en els darrers vint anys, han quedat en una situaci\u00f3 d\u2019<em>impasse<\/em>, especialment en la darrera d\u00e8cada. Aquest 2019, amb un nou Parlament Europeu i una nova Comissi\u00f3 Europea, caldr\u00e0 esperar quina \u00e9s la nova proposta comunit\u00e0ria sobre la gesti\u00f3 de la immigraci\u00f3 i l\u2019asil.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Continuar amb la din\u00e0mica d\u2019aquests darrers anys \u00e9s decidir, definitivament, que no es vol avan\u00e7ar en una pol\u00edtica d\u2019immigraci\u00f3 i asil comuna, i que l\u2019\u00fanic espai de converg\u00e8ncia en el que hi ha voluntat de treballar conjuntament \u00e9s el control de les fronteres exteriors. Aquest escenari factible condicionar\u00e0 en bona part el futur del projecte de la Uni\u00f3 Europea: de moment, la falta de consens i coordinaci\u00f3 ja ha posat en risc la lliure circulaci\u00f3 en l\u2019espai Schengen, i preveure el retorn de les fronteres interiors \u00e9s un risc cre\u00efble avui en dia <span class=\"note-item\"><a href=\"#note-07\" class=\"scroll-to\">[7]<\/a><span class=\"note-item-tooltip\">7 \u2014 Carrera, S., Stefan, M., Chun Lu, N. &amp; Vosyli\u016bt\u0117, L. Brussels: European Parliament.\n<\/span><\/span>. Aquest seria segurament l\u2019escenari m\u00e9s factible, per\u00f2 \u00e9s el que s\u2019ha demostrat que no proporciona els millors resultats <span class=\"note-item\"><a href=\"#note-08\" class=\"scroll-to\">[8]<\/a><span class=\"note-item-tooltip\">8 \u2014 Jakobson, M.L. &amp; Lauren, A. (2018). \u201cEuropean Migration Policy or Migration Policy in Europe?\u201d Paper Issue 18 July 2018. Tallinn: International Centre for Defence and Security. <a href=\"https:\/\/icds.ee\/european-migration-policy-or-migration-policy-in-europe\/\" rel=\"nofollow\">https:\/\/icds.ee\/european-migration-policy-or-migration-policy-in-europe\/<\/a>\n<\/span><\/span>. De fet, aquest avan\u00e7 parcial molt vinculat al principi intergovernamental deixa poques expectatives a superar la sobreatenci\u00f3 al control de fronteres, i augura que els aven\u00e7os en altres \u00e0mbits continuaran sent de car\u00e0cter fragmentat, i amb tend\u00e8ncia a construir cada cop uns consensos m\u00e9s de m\u00ednims, donada la bel\u00b7liger\u00e0ncia dels pa\u00efsos del Grup de Visegrad en&nbsp;parlar d\u2019immigraci\u00f3 i asil.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un escenari diferent requeriria tornar al consens (i l\u2019esperit) de Tampere, i avan\u00e7ar en la construcci\u00f3 ja no d\u2019una pol\u00edtica d\u2019immigraci\u00f3 i asil comuna, sin\u00f3 en el desenvolupament d\u2019instruments harmonitzats per gestionar parcialment les migracions i l\u2019asil en l\u2019\u00e0mbit europeu. Flexibilitzar i adequar les vies d&#8217;acc\u00e9s regulars \u00e9s clau, no nom\u00e9s per desenvolupar una pol\u00edtica p\u00fablica ordenada i equilibrada, sin\u00f3 tamb\u00e9 per evitar les disfuncions que suposa la irregularitat. Un escenari on es parli d&#8217;inclusi\u00f3 i de societat diverses, en un debat basat en els principis democr\u00e0tics i de benestar que sostenen les societats europees, i en el qual la lluita contra la discriminaci\u00f3 i els discursos d&#8217;odi ha de ser tamb\u00e9 priorit\u00e0ria. Un exemple d\u2019aquest escenari que contemplaria l\u2019harmonitzaci\u00f3 parcial d\u2019alguns \u00e0mbits seria explorar la possibilitat de dibuixar un aut\u00e8ntic sistema europeu com\u00fa d&#8217;asil, en el qual la determinaci\u00f3 de la necessitat de protecci\u00f3 podria deslligar-se del procediment. En el primer moment, l&#8217;Oficina Europea d&#8217;Asil (EASO) podria jugar un paper clau \u2014liderant o coordinant la revisi\u00f3 de les sol\u00b7licituds\u2014 per, en un segon moment, garantir la distribuci\u00f3 de les persones sol\u00b7licitants en un pa\u00eds UE d&#8217;acollida, atenent uns criteris de distribuci\u00f3 pr\u00e8viament aprovats seguint, per exemple, el model alemany. Amb aquesta l\u00f2gica, i aplicant el criteri de la subsidiarietat, es podria facilitar la participaci\u00f3 dels governs subestatals (regionals i\/o locals) en el proc\u00e9s d&#8217;acollida i integraci\u00f3 de la poblaci\u00f3 refugiada, i garantir millors resultats en aquest proc\u00e9s d\u2019inclusi\u00f3 d&#8217;acollida. Obrir el debat de la geometria variable en el cas de la gesti\u00f3 de la immigraci\u00f3 i asil a la Uni\u00f3 Europea t\u00e9 poc sentit perqu\u00e8 afectaria la perviv\u00e8ncia de l\u2019espai Schengen i la lliure circulaci\u00f3 de persones.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finalment, un tercer escenari seria avan\u00e7ar definitivament en la definici\u00f3 d\u2019una pol\u00edtica d\u2019immigraci\u00f3 i asil europea i comuna. Aquest escenari sembla, avui, totalment impracticable. No sembla factible que els estats membres cedeixin compet\u00e8ncies en mat\u00e8ria d\u2019immigraci\u00f3 i asil que vagin m\u00e9s enll\u00e0 del control de fronteres. Es poden revisar algunes directives que afecten les vies d\u2019acc\u00e9s m\u00e9s habituals, com els estudis, el treball temporal o l\u2019altament qualificat. Per\u00f2 no sembla viable que, en el curt termini, s\u2019explorin opcions i instruments que superin la fragmentaci\u00f3 del sistema, i que impulsin una mirada integral que vinculi aquestes pol\u00edtiques amb altres pol\u00edtiques comunit\u00e0ries, per altra banda tamb\u00e9 articulades per la via de la cooperaci\u00f3 intergovernamental m\u00e9s que per la l\u00f2gica supranacional, com les pol\u00edtiques d\u2019ocupaci\u00f3 o la pol\u00edtica exterior comuna. Si no hi ha canvis substantius, aquest <em>impasse<\/em> dels darrers anys s\u2019esdevindr\u00e0 la t\u00f2nica general, i la falta d\u2019una pol\u00edtica europea d\u2019immigraci\u00f3 i asil, d\u2019una veu comuna&nbsp;i compartida davant dels reptes actuals, impactaria encara m\u00e9s en la credibilitat del projecte europeu. Especialment en un tema que ha estat instrumentalitzat pels partits d\u2019extrema dreta que acompanyen els seus tradicionals discursos eur\u00f2fobs amb dur\u00edssims discursos xen\u00f2fobs.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">A tall de conclusi\u00f3<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Gaireb\u00e9 vint anys despr\u00e9s de la seva concepci\u00f3, la pol\u00edtica d&#8217;immigraci\u00f3 europea no ha estat explorada en totes les seves potencialitats. No es poden minimitzar les contribucions fetes des de 1999 fins a la data, perqu\u00e8 han constru\u00eft l\u2019experiment multilateral m\u00e9s innovador de pol\u00edtica migrat\u00f2ria. Per\u00f2 es tracta d&#8217;un proc\u00e9s inacabat, complex i amb algunes debilitats importants <span class=\"note-item\"><a href=\"#note-09\" class=\"scroll-to\">[9]<\/a><span class=\"note-item-tooltip\">9 \u2014 Pinyol-Jimenez, Gemma. L&#8217;abs\u00e8ncia de discussions compartides sobre com es vol gestionar la immigraci\u00f3 a la Uni\u00f3 Europea, amb quins instruments i amb quins objectius, ha deixat el relat de la pol\u00edtica migrat\u00f2ria centrat b\u00e0sicament en el control de fronteres.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aquest debat desequilibrat ha perm\u00e8s als estats membres seguir sense afrontar una discussi\u00f3 necess\u00e0ria a l\u2019arena europea, i construir narratives pr\u00f2pies en els escenaris nacionals, moltes vegades contraris als principis de solidaritat i respecte a la diversitat sobre els quals se sustenta la Uni\u00f3. La tradicional tensi\u00f3 intergovernamental-supranacional adquireix en l&#8217;\u00e0mbit migratori una for\u00e7a inusitada i de dif\u00edcil soluci\u00f3.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Obrir un espai de debat i reflexi\u00f3 assossegada sobre la q\u00fcesti\u00f3 migrat\u00f2ria sembla un impossible en la Uni\u00f3 Europea d&#8217;avui dia, amb una fractura est-oest evidenciada en les negatives dels pa\u00efsos m\u00e9s orientals de la Uni\u00f3 a signar el Pacte Global sobre Migraci\u00f3, i amb un creixement innegable dels partits amb discursos xen\u00f2fobs. Per\u00f2 \u00e9s imprescindible. Perqu\u00e8 el fenomen migratori \u00e9s una constant dels nostres temps, i la capacitat de resposta dels pa\u00efsos de la Uni\u00f3 Europea tindr\u00e0 millors resultats si avancen, ni que sigui parcialment, en una gesti\u00f3 conjunta que vagi&nbsp;m\u00e9s enll\u00e0 del control de fronteres. I perqu\u00e8 en un context on creixen els discursos que fomenten l&#8217;odi al diferent, cal donar una resposta clara i coordinada a aquesta amena\u00e7a, que posa en risc la cohesi\u00f3 social, i el model de conviv\u00e8ncia que recull el <em>motto<\/em> de la Uni\u00f3 Europea (units en la diversitat).
